Acceptance of Terms
These Terms of Use (“Terms”) are a legally binding agreement between you and Secondhand Confessions (“Secondhand Confessions,” “we,” “us,” or “our”). They govern your access to and use of secondhandconfessions.com, the Secondhand Confessions podcast and podcast feeds, show notes, newsletters, contact and episode submission forms, and other digital content or services that we make available and that link to these Terms (collectively, the “Services”).
By accessing or using any part of the Services, including by visiting the website, listening to or downloading an episode through an authorized platform, or sending us a submission, you acknowledge that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Any additional terms presented for a particular feature apply to that feature, and, if they conflict with these Terms, control only to the extent of the conflict.

Eligibility
The Services are intended for a general audience. You must be at least 13 years old to use the Services. If you are between 13 and 17, you may use the Services only with the permission and direct supervision of a parent or legal guardian who agrees to these Terms on your behalf. Children under 13 may not use the Services or provide personal information to us.
You must be at least 18 years old (or have the express authorization and supervision of a parent or legal guardian) to submit a confession, story, voice recording, photograph, message, or other material for possible use in an episode or related content. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Privacy
Our Privacy Policy, available through secondhandconfessions.com, explains how we collect, use, store, and disclose personal information in connection with the Services and is incorporated into these Terms by reference. Please review it before using the Services or sending us information. You understand that internet transmissions are not completely secure and that information you send electronically is transmitted at your own risk.

Changes to These Terms and Services
We may revise these Terms periodically to reflect changes to the Services, our practices, or applicable law. The revised Terms become effective when posted unless a later effective date is stated. When required by law, or when we determine that a change is material, we will provide additional notice through the Services or another reasonable method. Your continued use of the Services after revised Terms take effect constitutes acceptance of the revisions.
We may change, suspend, restrict, or discontinue any part of the Services at any time. We do not guarantee that any episode, feed, page, submission method, or other content will remain available, and we are not obligated to preserve or provide copies of content.

Limited License and Permitted Use
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services for lawful, personal, and non-commercial entertainment and informational purposes. You may stream or download podcast episodes through authorized podcast platforms and share links to publicly available pages or episodes.
Except as expressly authorized by us in writing or permitted by applicable law, you may not copy, reproduce, republish, upload, post, transmit, distribute, sell, license, publicly perform or display, modify, create derivative works from, or otherwise exploit the Services or their content. You may not remove copyright, trademark, attribution, or other proprietary notices. No rights are granted by implication, estoppel, or otherwise.

Intellectual Property
The Services and their content, including podcast episodes, audio recordings, show notes, transcripts, text, graphics, artwork, photographs, logos, names, slogans, music, sound design, website design, and the selection and arrangement of those materials, are owned by Secondhand Confessions and are protected by copyright, trademark, and other intellectual property laws. Secondhand Confessions and its associated names, logos, and branding may not be used without our prior written permission. Third-party names and marks remain the property of their respective owners.
If you believe material available through the Services infringes your copyright or other intellectual property rights, contact us using the information in Section 18.0, and identify the protected work, the allegedly infringing material and its location, your contact information, and the basis for your claim. We may remove or restrict access to material when we reasonably believe doing so is appropriate.

Listener Submissions
The Services may allow you to send us confessions, stories, episode ideas, voice recordings, photographs, messages, feedback, or other materials (collectively, “Submissions”) through a form, email, social media message, or another method we identify. You retain any ownership rights you lawfully hold in a Submission. By sending a Submission, however, you grant Secondhand Confessions and its service providers, contractors, licensees, successors, and assigns a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid, transferable, and sublicensable license to host, store, reproduce, record, edit, adapt, excerpt, translate, combine with other material, create derivative works from, publish, distribute, publicly perform, publicly display, broadcast, promote, and otherwise use the Submission, in whole or in part, in any media or format now known or later developed, in connection with the podcast, the Services, and their promotion.
This license includes permission to use any name, voice, likeness, biographical information, and other identifying material that you intentionally include in the Submission. We may use a pseudonym, remove identifying details, edit for length or clarity, or decide not to use a Submission, but we do not promise anonymity, confidentiality, publication, attribution, editorial approval, compensation, or return of submitted materials. A request to withdraw a Submission will not require us to remove or stop using material already produced, published, distributed, licensed, or incorporated into other content, except where applicable law requires otherwise.

Submission Responsibilities
You represent and warrant that you own or control all rights necessary to provide each Submission and grant the license in Section 7.0; that the Submission is accurate to the best of your knowledge and is not intentionally misleading; and that our permitted use of the Submission will not violate any law or any third party’s copyright, trademark, contract, confidentiality, privacy, publicity, or other rights. If a Submission includes another person’s identity, voice, image, private information, or creative work, you are responsible for obtaining any permission required for the uses described in these Terms.
Do not send information that you are legally prohibited from disclosing, confidential information belonging to another person or organization, or sensitive personal information that is unnecessary for the story. You are solely responsible for your Submission and any consequences of providing it. We may review, edit, reject, remove, or decline to use any Submission at any time, but we have no obligation to monitor submissions or verify their truth, legality, or accuracy.

Prohibited Conduct
You may not use the Services to violate any law; infringe or misappropriate intellectual property, privacy, publicity, contractual, or other rights; impersonate another person or misrepresent an affiliation; harass, threaten, abuse, defame, stalk, or exploit another person; submit material that is unlawful, fraudulent, malicious, hateful, obscene, or designed to facilitate harm; transmit malware or harmful code; probe or bypass security measures; interfere with the operation of the Services; obtain information by a method not intentionally made available; use automated tools to scrape, crawl, harvest, or copy content without permission; frame or mirror the Services; or use the Services or their content for unauthorized commercial, advertising, or competitive purposes.
We may investigate suspected violations, preserve or disclose information when reasonably necessary to comply with law or protect rights and safety, and restrict access to the Services or submissions when we believe these Terms have been violated. This section does not limit any rights or remedies available to us under law.

Third-Party Platforms, Links, and Content
The Services may be distributed through or link to podcast directories, social networks, analytics providers, advertisers, sponsors, websites, applications, and other services operated by third parties. Those third parties are independent from Secondhand Confessions and may apply their own terms and privacy policies. We do not control and are not responsible for their availability, security, content, accuracy, products, practices, or handling of information. A link, mention, guest appearance, sponsorship, or advertisement does not necessarily constitute our endorsement. Your interactions and transactions with third parties are solely between you and the third party and are undertaken at your own risk.

Podcast and Informational Content
Secondhand Confessions is an entertainment podcast. Episodes and related materials may discuss personal recollections, listener submissions, opinions, rumors, online posts, public sources, or stories supplied by third parties. We may edit material for timing, clarity, storytelling, privacy, or production. We do not promise that any account is complete, current, or independently verified, and the views expressed by hosts, guests, submitters, or referenced third parties do not necessarily represent the views of Secondhand Confessions.
Nothing in the Services is legal, medical, mental health, financial, safety, investigative, or other professional advice, and no professional, fiduciary, or confidential relationship is created by your use of the Services. Do not rely on the Services as a substitute for advice from a qualified professional. Some content may involve mature, sensitive, disturbing, or offensive subjects; you are responsible for deciding whether it is appropriate for you.

Availability, Corrections, and Termination
We may correct errors, update or remove content, change release schedules, and suspend or discontinue access to any part of the Services without notice. We may also block or terminate your access if we reasonably believe you have violated these Terms, created risk or possible legal exposure, or interfered with the Services or others. Upon termination, the license granted to you under Section 5.0 ends immediately. Provisions that by their nature should survive termination, including those concerning ownership, Submissions, disclaimers, limitations of liability, indemnification, disputes, and miscellaneous terms, will survive.

Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SECONDHAND CONFESSIONS DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CONTENT OR SUBMISSION WILL BE STORED, PUBLISHED, OR REMAIN AVAILABLE.
Some jurisdictions do not allow certain warranty exclusions, so some of the exclusions above may not apply to you. In that event, the warranties are limited to the fullest extent permitted by applicable law.

Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SECONDHAND CONFESSIONS AND ITS OWNERS, HOSTS, PRODUCERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSS, ARISING OUT OF OR RELATING TO THE SERVICES, ANY CONTENT, ANY SUBMISSION, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF SECONDHAND CONFESSIONS AND THE PARTIES IDENTIFIED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED UNITED STATES DOLLARS OR THE AMOUNT YOU PAID DIRECTLY TO SECONDHAND CONFESSIONS FOR THE SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
The limitations in this section apply regardless of the form of action and even if a remedy fails of its essential purpose. Applicable law may not permit some limitations, in which case they apply only to the maximum extent permitted.

Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Secondhand Confessions and its owners, hosts, producers, employees, contractors, agents, affiliates, licensors, service providers, successors, and assigns from claims, liabilities, damages, judgments, awards, losses, costs, expenses, and reasonable attorneys’ fees arising out of or relating to your use or misuse of the Services, your Submissions, your violation of these Terms, or your violation of another person’s rights. We may assume control of the defense of a matter subject to indemnification, and you agree to cooperate with that defense. You may not settle such a matter in a way that imposes liability or an admission on an indemnified party without our prior written consent.

Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-laws principles, except to the extent federal law applies. Before filing a claim, you and Secondhand Confessions agree to make a good faith effort to resolve the dispute informally by sending written notice describing the dispute and requested resolution. If the dispute is not resolved within 30 days after notice is received, either party may pursue available remedies.
Unless applicable law requires otherwise, any judicial proceeding arising out of or relating to the Services or these Terms must be brought exclusively in a state or federal court of competent jurisdiction located in Alabama, and each party consents to personal jurisdiction and venue there. Nothing in this section prevents either party from seeking temporary or injunctive relief to protect intellectual property, privacy, security, or safety interests. If you are a consumer, this section does not deprive you of mandatory protections provided by the law of your residence.

Miscellaneous
These Terms, together with the Privacy Policy and any feature-specific terms that expressly apply, constitute the entire agreement between you and Secondhand Confessions regarding the Services and supersede prior or contemporaneous understandings on that subject. If any provision is held invalid or unenforceable, it will be limited or modified to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign these Terms in connection with a reorganization, financing, merger, acquisition, sale of assets, or by operation of law. These Terms do not create an agency, partnership, joint venture, employment, or fiduciary relationship. Section headings are for convenience only. All rights not expressly granted are reserved.

Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Secondhand Confessions and its owners, hosts, producers, employees, contractors, agents, affiliates, licensors, service providers, successors, and assigns from claims, liabilities, damages, judgments, awards, losses, costs, expenses, and reasonable attorneys’ fees arising out of or relating to your use or misuse of the Services, your Submissions, your violation of these Terms, or your violation of another person’s rights. We may assume control of the defense of a matter subject to indemnification, and you agree to cooperate with that defense. You may not settle such a matter in a way that imposes liability or an admission on an indemnified party without our prior written consent.

Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-laws principles, except to the extent federal law applies. Before filing a claim, you and Secondhand Confessions agree to make a good faith effort to resolve the dispute informally by sending written notice describing the dispute and requested resolution. If the dispute is not resolved within 30 days after notice is received, either party may pursue available remedies.
Unless applicable law requires otherwise, any judicial proceeding arising out of or relating to the Services or these Terms must be brought exclusively in a state or federal court of competent jurisdiction located in Alabama, and each party consents to personal jurisdiction and venue there. Nothing in this section prevents either party from seeking temporary or injunctive relief to protect intellectual property, privacy, security, or safety interests. If you are a consumer, this section does not deprive you of mandatory protections provided by the law of your residence.

Miscellaneous
These Terms, together with the Privacy Policy and any feature-specific terms that expressly apply, constitute the entire agreement between you and Secondhand Confessions regarding the Services and supersede prior or contemporaneous understandings on that subject. If any provision is held invalid or unenforceable, it will be limited or modified to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign these Terms in connection with a reorganization, financing, merger, acquisition, sale of assets, or by operation of law. These Terms do not create an agency, partnership, joint venture, employment, or fiduciary relationship. Section headings are for convenience only. All rights not expressly granted are reserved.

Acceptance of Terms
These Terms of Use (“Terms”) are a legally binding agreement between you and Secondhand Confessions (“Secondhand Confessions,” “we,” “us,” or “our”). They govern your access to and use of secondhandconfessions.com, the Secondhand Confessions podcast and podcast feeds, show notes, newsletters, contact and episode submission forms, and other digital content or services that we make available and that link to these Terms (collectively, the “Services”).
By accessing or using any part of the Services, including by visiting the website, listening to or downloading an episode through an authorized platform, or sending us a submission, you acknowledge that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Any additional terms presented for a particular feature apply to that feature, and, if they conflict with these Terms, control only to the extent of the conflict.

Eligibility
The Services are intended for a general audience. You must be at least 13 years old to use the Services. If you are between 13 and 17, you may use the Services only with the permission and direct supervision of a parent or legal guardian who agrees to these Terms on your behalf. Children under 13 may not use the Services or provide personal information to us.
You must be at least 18 years old (or have the express authorization and supervision of a parent or legal guardian) to submit a confession, story, voice recording, photograph, message, or other material for possible use in an episode or related content. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Privacy
Our Privacy Policy, available through secondhandconfessions.com, explains how we collect, use, store, and disclose personal information in connection with the Services and is incorporated into these Terms by reference. Please review it before using the Services or sending us information. You understand that internet transmissions are not completely secure and that information you send electronically is transmitted at your own risk.

Changes to These Terms and Services
We may revise these Terms periodically to reflect changes to the Services, our practices, or applicable law. The revised Terms become effective when posted unless a later effective date is stated. When required by law, or when we determine that a change is material, we will provide additional notice through the Services or another reasonable method. Your continued use of the Services after revised Terms take effect constitutes acceptance of the revisions.
We may change, suspend, restrict, or discontinue any part of the Services at any time. We do not guarantee that any episode, feed, page, submission method, or other content will remain available, and we are not obligated to preserve or provide copies of content.

Limited License and Permitted Use
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services for lawful, personal, and non-commercial entertainment and informational purposes. You may stream or download podcast episodes through authorized podcast platforms and share links to publicly available pages or episodes.
Except as expressly authorized by us in writing or permitted by applicable law, you may not copy, reproduce, republish, upload, post, transmit, distribute, sell, license, publicly perform or display, modify, create derivative works from, or otherwise exploit the Services or their content. You may not remove copyright, trademark, attribution, or other proprietary notices. No rights are granted by implication, estoppel, or otherwise.

Intellectual Property
The Services and their content, including podcast episodes, audio recordings, show notes, transcripts, text, graphics, artwork, photographs, logos, names, slogans, music, sound design, website design, and the selection and arrangement of those materials, are owned by Secondhand Confessions and are protected by copyright, trademark, and other intellectual property laws. Secondhand Confessions and its associated names, logos, and branding may not be used without our prior written permission. Third-party names and marks remain the property of their respective owners.
If you believe material available through the Services infringes your copyright or other intellectual property rights, contact us using the information in Section 18.0, and identify the protected work, the allegedly infringing material and its location, your contact information, and the basis for your claim. We may remove or restrict access to material when we reasonably believe doing so is appropriate.

Listener Submissions
The Services may allow you to send us confessions, stories, episode ideas, voice recordings, photographs, messages, feedback, or other materials (collectively, “Submissions”) through a form, email, social media message, or another method we identify. You retain any ownership rights you lawfully hold in a Submission. By sending a Submission, however, you grant Secondhand Confessions and its service providers, contractors, licensees, successors, and assigns a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid, transferable, and sublicensable license to host, store, reproduce, record, edit, adapt, excerpt, translate, combine with other material, create derivative works from, publish, distribute, publicly perform, publicly display, broadcast, promote, and otherwise use the Submission, in whole or in part, in any media or format now known or later developed, in connection with the podcast, the Services, and their promotion.
This license includes permission to use any name, voice, likeness, biographical information, and other identifying material that you intentionally include in the Submission. We may use a pseudonym, remove identifying details, edit for length or clarity, or decide not to use a Submission, but we do not promise anonymity, confidentiality, publication, attribution, editorial approval, compensation, or return of submitted materials. A request to withdraw a Submission will not require us to remove or stop using material already produced, published, distributed, licensed, or incorporated into other content, except where applicable law requires otherwise.

Submission Responsibilities
You represent and warrant that you own or control all rights necessary to provide each Submission and grant the license in Section 7.0; that the Submission is accurate to the best of your knowledge and is not intentionally misleading; and that our permitted use of the Submission will not violate any law or any third party’s copyright, trademark, contract, confidentiality, privacy, publicity, or other rights. If a Submission includes another person’s identity, voice, image, private information, or creative work, you are responsible for obtaining any permission required for the uses described in these Terms.
Do not send information that you are legally prohibited from disclosing, confidential information belonging to another person or organization, or sensitive personal information that is unnecessary for the story. You are solely responsible for your Submission and any consequences of providing it. We may review, edit, reject, remove, or decline to use any Submission at any time, but we have no obligation to monitor submissions or verify their truth, legality, or accuracy.

Prohibited Conduct
You may not use the Services to violate any law; infringe or misappropriate intellectual property, privacy, publicity, contractual, or other rights; impersonate another person or misrepresent an affiliation; harass, threaten, abuse, defame, stalk, or exploit another person; submit material that is unlawful, fraudulent, malicious, hateful, obscene, or designed to facilitate harm; transmit malware or harmful code; probe or bypass security measures; interfere with the operation of the Services; obtain information by a method not intentionally made available; use automated tools to scrape, crawl, harvest, or copy content without permission; frame or mirror the Services; or use the Services or their content for unauthorized commercial, advertising, or competitive purposes.
We may investigate suspected violations, preserve or disclose information when reasonably necessary to comply with law or protect rights and safety, and restrict access to the Services or submissions when we believe these Terms have been violated. This section does not limit any rights or remedies available to us under law.

Third-Party Platforms, Links, and Content
The Services may be distributed through or link to podcast directories, social networks, analytics providers, advertisers, sponsors, websites, applications, and other services operated by third parties. Those third parties are independent from Secondhand Confessions and may apply their own terms and privacy policies. We do not control and are not responsible for their availability, security, content, accuracy, products, practices, or handling of information. A link, mention, guest appearance, sponsorship, or advertisement does not necessarily constitute our endorsement. Your interactions and transactions with third parties are solely between you and the third party and are undertaken at your own risk.

Podcast and Informational Content
Secondhand Confessions is an entertainment podcast. Episodes and related materials may discuss personal recollections, listener submissions, opinions, rumors, online posts, public sources, or stories supplied by third parties. We may edit material for timing, clarity, storytelling, privacy, or production. We do not promise that any account is complete, current, or independently verified, and the views expressed by hosts, guests, submitters, or referenced third parties do not necessarily represent the views of Secondhand Confessions.
Nothing in the Services is legal, medical, mental health, financial, safety, investigative, or other professional advice, and no professional, fiduciary, or confidential relationship is created by your use of the Services. Do not rely on the Services as a substitute for advice from a qualified professional. Some content may involve mature, sensitive, disturbing, or offensive subjects; you are responsible for deciding whether it is appropriate for you.

Availability, Corrections, and Termination
We may correct errors, update or remove content, change release schedules, and suspend or discontinue access to any part of the Services without notice. We may also block or terminate your access if we reasonably believe you have violated these Terms, created risk or possible legal exposure, or interfered with the Services or others. Upon termination, the license granted to you under Section 5.0 ends immediately. Provisions that by their nature should survive termination, including those concerning ownership, Submissions, disclaimers, limitations of liability, indemnification, disputes, and miscellaneous terms, will survive.

Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SECONDHAND CONFESSIONS DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CONTENT OR SUBMISSION WILL BE STORED, PUBLISHED, OR REMAIN AVAILABLE.
Some jurisdictions do not allow certain warranty exclusions, so some of the exclusions above may not apply to you. In that event, the warranties are limited to the fullest extent permitted by applicable law.
